Interpretation

The terms with capitalised initial letters are defined as follows. These definitions apply equally whether the terms are used in the singular or plural form.

Definitions

For the purpose of this Privacy Policy the following terms are defined as:

Affiliate refers to any organisation that either has control over, is controlled by, or shares common control with a party. In this context, "control" signifies ownership of 50% or more of the shares, equity interests, or other securities that grant the right to vote for the election of directors or other governing bodies.

Apple refers to Apple Inc.

Application refers to the software provided by the Company, which you have downloaded onto any electronic device, and is called BedCheck Alarm.

Business, under the CCPA (California Consumer Privacy Act), designates the Company as the legal entity that gathers consumers' personal data and determines the purposes and methods for processing it.

Company (referred to as 'the Company', 'We', 'Us', or 'Our' in this Agreement) refers to SETHENGINE, located at MAAIERSTRAAT 26. Under GDPR, the Company is the Data Controller.

Consumer, under the CCPA (California Consumer Privacy Act), refers to an individual who is a resident of California.

Data Controller, as per the GDPR (General Data Protection Regulation), refers to the Company, which, either independently or together with others, defines the purposes and methods for processing Personal Data.

Device means any electronic device capable of accessing the Service, such as a computer, digital tablet, or cellphone.

Do Not Track (DNT) is a concept advocated by U.S. regulatory authorities, particularly the Federal Trade Commission (FTC), to allow internet users to control how their online activities are tracked across websites.

Google refers to Google LLC.

Personal Data is any information related to an identified or identifiable individual. Under the GDPR, Personal Data refers to information related to You, such as your name, identification number, location data, online identifiers, or other factors specific to your physical, physiological, genetic, mental, economic, cultural, or social identity.

Registered User refers to an individual with an active account registered on the Company's server and is subject to all clauses regarding the User in this Agreement.

Sale, as defined by the CCPA, means renting, selling, releasing, disclosing, or transferring a Consumer's Personal Information to another business or third party for monetary or other valuable consideration.

Service refers to the Application.

Service Provider refers to any natural or legal person who processes data on behalf of the Company. This includes third-party companies or individuals hired to facilitate the Service.

Third-party Social Media Service refers to any website or social network platform.

Usage Data refers to data collected automatically, either generated through the use of the Service or from the Service infrastructure itself.

You (also referred to as "the User" in this Agreement) means the individual accessing or using the Service, or the company or legal entity on whose behalf the Service is being accessed or used, as applicable.

Collecting and Using Your Personal Data

Types of Data Collected

Account Data

Account data is collected ONLY from registered users. During the registration process, we gather the following information from you:

Full Name: This does not have to be your actual full name, as you can modify this information when signing up through Apple.
Email Address: We collect your real email address ONLY if you explicitly consent to share it. Otherwise, we gather a randomly generated email address through the "Sign in with Apple" feature.

As of the latest update to this Privacy Policy, your account data does NOT include payment information or usage data.

Personal Data

While using our service, we may ask you to provide certain personally identifiable information that can be used to contact or identify you. This information may include, but is not limited to:

Usage Data

Usage Data is collected automatically when you use the service. This may include information such as your device's Internet Protocol (IP) address, browser type, browser version, the pages of our service you visit, the date and time of your visit, time spent on those pages, unique device identifiers, and other diagnostic data.

When accessing the service via a mobile device, we may automatically collect additional information, including but not limited to the type of mobile device, its unique ID, the IP address, mobile operating system, type of mobile internet browser, unique device identifiers, and other diagnostic data.

Use of Your Personal Data
